LION MOUNTAIN DESIGNS — MASTER TERMS OF SERVICE & CONDITIONS

Welcome to Lion Mountain Designs (“Company,” “we,” “us,” “our”). These Terms of Service & Conditions (“Terms”) govern your use of our website, online store, and all related services (“Services”), as well as all purchases made from Lion Mountain Designs. By accessing or using our Services, or by placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services or place an order.


SECTION 1 — ACCESS & ACCOUNT REQUIREMENTS

By using our Services, you represent that you are at least the age of majority in your jurisdiction and that all information you provide (email, billing, shipping, payment details) is accurate, current, and complete. You are responsible for maintaining the security of your account credentials and all activity under your account. Accounts may not be transferred or sold.


SECTION 2 — PRODUCTS & REPRESENTATION

We make every effort to accurately display our products; however, colors and appearance may vary due to device settings. We do not warrant that products will meet your expectations or appear exactly as displayed. Product descriptions, availability, and pricing may change at any time without notice. We may limit quantities or discontinue products at our discretion.


SECTION 3 — CUSTOM & MADE‑TO‑ORDER PRODUCTS

All Lion Mountain Designs products are custom-made and personalized. No two items are identical. Variations in color, texture, or finish are normal and not considered defects.

3a. Custom Item Finality

All custom and personalized sales are final once production begins. Custom items cannot be cancelled, refunded, or returned after the 2‑hour cancellation window.

3b. Customer Accuracy Requirement

By placing an order, you confirm that:

  • All submitted information (names, dates, spelling, logos, images) is accurate.

  • You understand the product is made specifically for you and cannot be resold or returned.

  • you acknowledge that a non-refundable $25.00 design fee applies to all orders, including cancellations made within the 2-hour cancellation window. This fee covers design work initiated immediately upon receipt of your order.

  • You have read and agree to our Refund & Return Policy.


SECTION 4 — ORDER ACCEPTANCE

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. Your order is accepted only once payment is processed and confirmed. Orders may not be cancelled after acceptance unless permitted under our policies.

Purchases are subject to our Refund & Return Policy.


SECTION 5 — DESIGN PROOF APPROVAL

A digital proof will be sent before production. You must review all details carefully.

Approval of a proof (email, text, or written confirmation):

  • Confirms the design is correct.

  • Authorizes production.

  • Locks the order — no changes, cancellations, or refunds allowed.

If you do not respond within 7 days, we may proceed using the information provided at checkout.

Please note that the $25.00 design fee is non-refundable regardless of whether a proof has been sent, as design work begins immediately upon order placement.

Customer Errors

We are not responsible for:

  • Incorrect information submitted by the customer

  • Typos, misspellings, wrong dates

  • Low‑resolution or incorrect logo/image files

  • Approval of a proof containing errors

No refund or replacement will be issued for errors present in the approved proof.


SECTION 6 — INTELLECTUAL PROPERTY & MARKETING LICENSE

6a. Customer Ownership Warranty

By submitting any logo, image, or design file, you warrant that:

  • You own the rights or have written permission to use the materials.

  • You assume full legal responsibility for any IP claims arising from your submissions.

  • Lion Mountain Designs is not liable for trademark or copyright infringement caused by customer-submitted materials.

6b. Marketing & Advertising License

By placing an order, you grant Lion Mountain Designs a perpetual, worldwide, royalty‑free, non‑exclusive license to photograph, display, reproduce, and use images of your completed order—including your name, business name, logo, or design—for marketing purposes, including:

  • Social media

  • Website galleries

  • Email campaigns

  • Print advertising

  • Trade shows

  • Portfolios

  • Promotional materials

This license survives the completion of your order.

To opt out, you must notify us in writing at the time of purchase. Requests made after production begins will not be honored.

6c. No Compensation

You acknowledge that no compensation or credit is owed for our use of your completed order images.

6d. Waiver of Claims

You waive any claim against Lion Mountain Designs for use of your completed order images consistent with this license.


SECTION 7 — PRICES & BILLING

Prices may change without notice. Posted prices exclude taxes, shipping, handling, customs, and import fees unless stated otherwise. You agree to provide accurate payment information and authorize all charges incurred.


SECTION 8 — SHIPPING & DELIVERY

Delivery times are estimates only. We are not responsible for:

  • Carrier delays

  • Customs delays

  • Lost, stolen, or delayed packages once transferred to the carrier

Shipping fees are non‑refundable.


SECTION 9 — STANDARD RETURN POLICY (NON‑CUSTOM ITEMS ONLY)

We offer a 30‑day return policy for eligible non‑custom items.

Eligibility

Items must be:

  • Unused

  • Unworn

  • In original packaging

  • With tags

  • Accompanied by proof of purchase

How to Start a Return

If accepted, we will provide:

  • A prepaid return label

  • Instructions for return shipment

Items sent without prior approval will not be accepted.

Damages & Issues

Inspect your order upon delivery. Contact us immediately if defective, damaged, or incorrect.

Exceptions

We cannot accept returns for:

  • Perishable goods

  • Custom/personalized items

  • Special orders

  • Personal care items

  • Hazardous materials

  • Flammable liquids or gases

  • Sale items

  • Gift cards

Exchanges

Return the item; once accepted, place a new order.

EU 14‑Day Cooling‑Off Period

EU customers may cancel or return within 14 days for any reason. Items must meet standard eligibility requirements.

Refunds

Approved refunds are issued within 10 business days to the original payment method. If 15 business days pass without refund posting, contact us.


SECTION 10 — THIRD‑PARTY TOOLS & LINKS

Optional tools and third‑party links are provided “as is.” We are not responsible for third‑party content, accuracy, or transactions.


SECTION 11 — RELATIONSHIP WITH SHOPIFY

Lion Mountain Designs is powered by Shopify. Shopify is not responsible for any sales, products, or transactions between you and Lion Mountain Designs.


SECTION 12 — FEEDBACK LICENSE

Any feedback you submit grants us a perpetual, worldwide, royalty‑free license to use it for any purpose. You represent that you own the rights to all feedback submitted.


SECTION 13 — PROHIBITED USES

You may not use the Services for unlawful, harmful, fraudulent, or abusive purposes. You may not:

  • Violate IP rights

  • Upload malware

  • Scrape or extract data

  • Use automated bots or agents

  • Circumvent security measures

Violations may result in account termination.


SECTION 14 — AGENT USE

Agents (autonomous software) must identify themselves and comply with all requirements. We may block or limit Agent access at any time.


SECTION 15 — TERMINATION

We may terminate access at any time. Sections that logically survive termination will continue to apply.


SECTION 16 — WARRANTY DISCLAIMER

All products and Services are provided “as is” and “as available.” We disclaim all implied warranties except where prohibited by law.


SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Lion Mountain Designs is not liable for:

  • Indirect or consequential damages

  • Lost profits, revenue, or data

  • Emotional dissatisfaction with a correctly produced custom item

  • Carrier delays

Our total liability shall not exceed the amount paid for the order in question.


SECTION 18 — INDEMNIFICATION

You agree to indemnify and hold harmless Lion Mountain Designs and Shopify from claims arising from your use of the Services or breach of these Terms.


SECTION 19 — SEVERABILITY

If any provision is found unenforceable, the remainder of the Terms remain in effect.


SECTION 20 — WAIVER & ENTIRE AGREEMENT

Failure to enforce a right does not constitute a waiver. These Terms constitute the entire agreement between you and Lion Mountain Designs.


SECTION 21 — ASSIGNMENT

You may not assign your rights without our written consent. We may assign our rights without notice.


SECTION 22 — GOVERNING LAW

These Terms are governed by the laws of the State of Florida. You consent to jurisdiction in Florida courts.


SECTION 23 — HEADINGS

Headings are for convenience only and do not affect interpretation.


SECTION 24 — CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
